Options for Resolution
The Non-Contested "Kitchen Table" Divorce
This process involves you and your spouse (preferably after consultation
with your attorney to obtain the proper forms and agenda) sitting down
"at the kitchen table" and working out for yourselves what the
two of you want to do. This is a "non-contested" divorce. All
matters are settled and agreed upon by you and your spouse before filing
your divorce with the court. Only one of you has an attorney who represents
that person only, and prepares the settlement documents to submit to the
court.
Benefit
This method, if successful, usually involves the lowest up front costs.
Possible Disadvantage
Because an attorney only represents one of the parties, careful consideration
should be given before entering into such a legal document without legal
guidance. Even though this divorce process may take less time and cost
less up front, there is also the potential to make long-term, permanent
mistakes.
