Adversarial Divorce Litigation
The divorce litigation involves your lawyer, your spouse's lawyer and
the courts. This can be a relatively long and expensive process focused
on proving your case, based on the history of your marriage rather than
a forward focused, problem solving method. After gathering evidence, if
you and your spouse cannot negotiate a settlement through your lawyers,
a judge will hear evidence and make decisions for you.
Advantages/Disadvantages
An Adversarial Divorce may be necessary in very high conflict families
or if you have no confidence in the integrity of your spouse. There are
plenty of disadvantages however:

- Takes too long.
- Heightens conflict, inflicts too much pain, and can leave both spouses
in a divorce feeling like losers.
